On Friday 15th, Donald Trump, in a move to Bypass Congress, declared a National Emergency at the Southern border. This gives him the money he needs to build a wall, one of his central Campaign Promises. He announced this in a televised event in the Rose Garden, claiming he is protecting the country from drugs, criminals and, Illegal Immigration from Mexico.
The declaration gives the President 3.6 billion from military construction and 2.5 billion from counternarcotics programs. Combined with the 1.3 Billion Congress authorized for Trump on February 14th he has 8 Billion Dollars to work with, more than 2 Billion more than his original demand of 5.7 billion.
However, this move has faced some backlash, mostly from Democrats, who believe it is an unconstitutional move. “This is plainly a power grab by a disappointed president, who has gone outside the bounds of the law to try and get what he failed to achieve in the constitutional legislative process,” Speaker Pelosi and Minority Leader Schumer said in a joint statement. The 2 pledged to overturn the decision and asked for Republicans to join them. House Democrats plan to introduce a bill to reverse the presidents move but to reverse it would require getting passed in the Republican-controlled Senate.
But legislation isn't the only way Democrats plan to fight against the Declaration. Its expected some Democrats and activists will take it to courts. The white house can make arguments to justify its decision, but the court can decide they are stretching the intent of the law. White House Officials have rejected the idea that this creates a precedent for future presidents to ignore Congress. “It actually creates zero precedent” the White House chief of staff told reporters Friday morning. “This is an Authority given to the president in law already. It's not as if he didn't get what he wanted and waved a magic wand to get some money.” Previous Presidents have declared National Emergencies 58 times and 31 of these remain active. Trump was among many Republicans who criticized Former President Obama for abusing executive Authority after failing to win over Congress.
